THE PRESENT STATE OF LAW BECOMES A FARCE WHEN THE OBJECTIVE IS TO CRIMINALIZE INDEPENDENTISM .. by RE-EVOLUCIÓN
(leer en castellano abajo) Seven young independentists from Republic Defense Committees (CDRs) arrested on suspicion last Monday arrived at the Spanish Court with a Civil Guard bus around seven in the morning but did not begin to testify until 11.
They were refused bail as it was claimed they might abscond.
The obvious reason for their detention is the taking of hostages against reaction to the upcoming sentencing of the Catalan leaders, within the next 10 days, by the politically appointed far right High Court.
The elected leaders have spent 2 years in jail awaiting trial for holding a long demanded, non binding, consultation referendum on Catalan Independence, which resulted in an overwhelmingly YES PLEASE vote despite massive military police attacks which shocked the world.
The CDRs are local horizontally organised committees set up after the wave of police and following far right and fascist attacks.
The 7 youths were arrested in an operation ordered by the holder of the court of instruction 6 of the Court, Manuel García Castellón.
According to the version of the Civil Guard, they were found material and substances considered ‘precursors’ of the manufacture of explosives, in fact things you might find in any garage or kitchen.
The arrests by the Madrid run paramilitary Guardia Civil were seen as an open return to Francoist dictatorship. The local parliament passed a motion demanding the removal of agents from the Civil Guard from Catalonia. But of course they have no powers to enforce this and the local Mossos police are now also run by central government.

Some media yesterday reproduced the police version, according to which two of the detainees acknowledged having bought material and having made tests for the manufacture of artifacts.
Xavier Pellicer, spokesperson for Solidarity Alert and coordinator of the defenses of detainees, attributes the alleged confessions of two of those arrested in the manipulation and “illegal” pressure of the Civil Guard.
In addition, in an interview published by VilaWeb, he complains that more than forty-eight hours after the arrests, these two arrested continued with an ex officio lawyer, despite the fact that the family had designated them as legal representatives.

The public ministry says that the detainees formed a ‘Catalan secessionist terrorist group’ and that they planned to attack between October 1 and the day the sentence against the Catalan leaders in the ‘Process’ Political show trial is made public.

In statements to TV3, Xavier Pellicer has talked about the “covert” application of the anti-terrorism law, that the detainees have been isolated, preventing them from meeting with the lawyers appointed by the family.
“They have been assigned two legal counsel. Imagine that at six in the morning they enter your house, handcuff you and have you without sleeping 24 or 36 hours, communicating false information and deceiving you, how would you react? ”Pellicer said on television.
The Catalan Parliament approved a motion calling for the removal of agents from the Civil Guard from Catalonia last Thursday.
This was just two years after the brutal action of this police force to stop the referendum on October 1, and four days after the nine arrests of members of the CDR accused of terrorism, JxCat and ERC parties agreed to submit to plenary vote the departure of the armed institute of the Catalan territory which was duly passed.

Los siete independentistas detenidos el lunes han llegado a la Audiencia española con un autobús de la Guardia Civil sobre las siete de la mañana pero no comenzaron a declarar hasta las 11.

Fueron detenidos en una operación ordenada por el titular del juzgado de instrucción 6 de la Audiencia, Manuel García Castellón.
Según la versión de la Guardia Civil, les encontraron material y sustancias consideradas ‘precursoras’ de la confección de explosivos.
Ante la audiencia, declaran representantes políticos, como Eulàlia Reguant y Maria Sirvent, y miembros de los CDR.
Algunos medios reprodujeron ayer la versión de la policía, según la cual dos de los detenidos reconocieron haber comprado material y haber hecho pruebas para la fabricación de artefactos.
Xavier Pellicer, portavoz de Alerta Solidaria y coordinador de las defensas de los detenidos, atribuye las supuestas confesiones de dos de los arrestados en la manipulación y presión ‘ilegal’ de la Guardia Civil.
Además, en una entrevista que publica VilaWeb, denuncia que más de cuarenta y ocho horas después de las detenciones, estos dos arrestados continuaban con un abogado de oficio, a pesar de que la familia les había designado a ellos como representantes legales.
El ministerio público dice que los detenidos formaban un ‘grupo terrorista de índole secesionista catalán’ y que planeaban atentar entre el primero de octubre y el día en que se haga pública la sentencia contra el proceso.
Los siete independentistas han pasado estas últimas tres noches en la comandancia de la Guardia Civil de la localidad de Tres Cantos (Madrid) desde donde pasarían a disposición judicial.
Las defensas de los miembros de los CDR denunciaron que habían sido detenciones ‘arbitrarias’ y que no habían podido acceder a documentación referente al caso, bajo secreto de sumario.
La mayoría de detenciones se hicieron en Sabadell, pero también hubo en municipios del Vallès Oriental y Osona. En total, la Guardia Civil detuvo a nueve personas, pero dos de ellas quedaron libres con cargos, si bien se mantiene la acusación de terrorismo.
En declaraciones a TV3, Xavier Pellicer ha hablado de aplicación ‘encubierta’ de la ley antiterrorista, que los detenidos han sido aislados, lo que les impide reunirse con los abogados designados por la familia.
“Les han sido asignados dos letrados de oficio. Imagínate que a las seis de la madrugada entran en tu casa, te esposan y te tienen sin dormir 24 o 36 horas, comunicándote informaciones falsas y engañándote, ¿cómo reaccionarías?”, dijo Pellicer en la televisión.
