This November 30th will mark 6 months since our anarchist comrade Abel was
kidnapped by the State and imprisoned in the Brians 2 CP Prison (Barcelona) with a firm sentence of 3 years and 9 months for the assault on a JUSAPOL protester who was carrying fascist symbols in 2018.

All the judicial instances of the State, ratified the accusation of the crime of injuries with aggravating factors of hatred with the aim of thus shielding his henchmen and further criminalizing the militancy of the comrade. A punishment, which the state has doubled, since during all this time his classification in ‘third degree regime’ has been rejected on two occasions, alluding to the ideology of the comrade and his lack of empathy with the “victim”.
This is how the Power justifies the reintegration programs (an essential condition for obtaining prison permits) to which the prisoner must submit in order to annihilate his revolutionary conscience: like a carpenter who hammers in the crooked nails on a board.
In this way, they turn the sentence into torture and blackmail.
But for us, their penitentiary policy based on exercising a set of structural violence according to the social position of the prisoners is nothing new: pure labor exploitation, humiliation and aggression by the jailers and
systematic mistreatment of families are just the tip of the iceberg.

We have never expected that their laws would serve as a tool for us, much less
aspired to reform them to soften the abuse and suffering. Because we know that
prison, like any other repressive institution, is an instrument at the service of the Power and the ruling class, whose objective is to annihilate any hint of
dissent in society.
An institution that only deserves to be destroyed and abolished.
Therefore, the jail, that hole where time seems to stop and sometimes
passes without us realizing it, is the place that Democracy has reserved for those who dare to question the established order. Throwing into it those who are forced to live in the blind spot and those who fight without ceasing.
We also go out to shout for all of them.
Because we do not forget the rest of the prisoners in struggle who resist inside and outside the State and those who could be yet to come. Because we are not satisfied with making the glass that separates us tremble with our fists, with hurrying our voices in a call against the visitors clock, with sending our affection by post.
We want to see those walls fall.
This November 30th we go out to defend what is ours and what they want to steal from us.

The anarchist Abel Mora: “I did not push the neo-Nazi, yet they condemn me for co-authorship because they say that everything was premeditated”

The activist entered Brians Prison on the same day that the amnesty law was passed, convicted of a crime of treasonous injury and aggravated hatred against a protester of the Jusapol Police March in 2018. The Supreme Court confirmed the sentence of three years and nine months in prison by considering him a co-author of an action he did not commit.

JUSAPOL is a Spanish association of the far right National Police Corps and the paramilitary Civil Guard. Wikipedia The Jusapol demo in Barcelona was to honor the cops drafted into Catalonia who failed to suppress the Independence Referendum, injuring thousands of voters. A young independentist Marcel Vivet was also arrested at the police demo, for hitting a nazi cop with a flagpole, but finally got off without prison.

Since last May 30, the anarchist Abel Mora has been held in the Brians penitentiary (Sant Esteve de Sesrovires, Baix Llobregat) to serve a sentence of three years and nine months for a crime of “treacherous and aggravated hate “
The events date back to November 10, 2018, when the Jusapol police union called an event at the Arc de Triomf in Barcelona to honor the officers who participated in the Copérnico police operation, which ended with more than a thousand voters injured in the polling stations of the October 1 referendum.
That day, Mora attended the anti-fascist rally called against the Jusapol event, which was blocked by a large police force in Plaça André Malraux in the Fort Pienc neighborhood.

After trying to break the police cordon and heavy charges and identifications by the riot police against the demonstrators, the protest was canceled and Mora left the area together with a colleague, in the direction of the Urquinaona metro stop.
Once there, on the access steps to the platform, they ran into a protester from the Jusapol event who was wearing the t-shirt of the neo-Nazi music group Arjuna, a cap and a Spanish flag, basically a nazi uniform.
At that moment, Mora’s companion pushed the man on the back and he fell down the stairs and lay on the ground. The assailant then fled up the stairs and Mora came out after him moments later, finding him already stopped in the narrow street by a private security guard who had intercepted him.
At this point, Abel admits that he grabbed the security guard’s arm to help his colleague get out of the immobilization.

A month later, the Mossos d’Esquadra arrested them both. In Abel’s case, they were plainclothes officers who approached him when he was leaving his home and took him to the dungeons of the Corts police station, where he spent a night before being brought before the court and released with charges
The cops identified them thanks to the images from the station’s video surveillance cameras that appear in the summary and the information contained in their profiles on different social networks, which is detailed in individual police reports in which the Mossos (‘Catalan’ police’) draw our ideological profile.

La Directa was able to collect Abel Mora’s testimony a few months ago, when he was waiting for the Supreme Court’s response to the cassation appeal he presented against a sentence of the Penal Court 2 of Barcelona that had already been ratified by the High Court of Barcelona.
His official lawyer was studying to request that he be released by applying the new amnesty law (later denied), but for the moment Mora sleeps in the cell as he predicted:
“I have no hope that the Supreme Court will acquit me, I am clear that I will go to jail and I assume it as a consequence of being a militant, I could have stayed home that day, but instead of it being for that (the arrest) would have been for anything else. For me it’s a punishment, it happened to me because the Mossos already knew who I was”.

As usual the Courts and police together committed revenge against a brave young anarchist who did nothing but support his comrade who pushed the nazi.
The description of the events attributed to the anarchist activist fits literally with the preamble and the articles of the amnesty law… a confrontation with an individual with Spanish and neo-Nazi symbols as part of a protest against the tribute to the Police Anti-Riots by the Jusapol police union on the first anniversary of the October 1 referendum.
From cover-up to co-authorship
Abel Mora has been singled out because in recent years he has had several open court proceedings and has suffered identifications due to social mobilizations and Evictions of Occupied Collective Spaces.
Some have been in person by police officers, but most of them have been obtained through photographs, videos, information on social networks or in person monitoring by plainclothes officers, as can be verified by lookingat his police file.
“They mix things up in a tendentious way to generate the imagination in the judge that I am a violent person”, he assured in reference to the police witnesses during the trial, in which the Mossos acted ex officio, and then the private accusation was added by the neo-Nazi.
The trial was held in October 2021 and only Mora appeared, as his colleague disappeared during the investigation phase and has been convicted in absentia because his whereabouts are unknown.
“I did not push the neo-Nazi down the stairs, but they condemn me for co-authorship because they determine that I helped my colleague escape and they say that everything was premeditated, when I assured that it was not so”.
In fact, the private prosecution requested a sentence of five years for co-authorship and two for cover-up, but this was not compatible and in the end the sentence was three years and nine months only for co-authorship. “One of the things I have made clear is that it is the same if you are honest in court”, concludes Abel Mora. The fine was ” moderate” which will mean a compensation of nine thousand euros.
According to Abel Mora, the fact that the demonstrator who went to the Jusapol provocation wearing an Arjuna T-shirt “proves that he was indeed a Nazi”.

The support group for Abel Mora and the collective Égida – Defensa Col·lectiva Anarquista https://t.me/egidadca/492 have called for 30th November 2024 another demonstration to demand the freedom of the anarchist prisoner, marking the 1st 6 months of his incarceration.

A member of the support group reflects “there are certain crimes that are imputed to activists in the framework of peaceful actions and others that have to do with direct action, and this serves the state to generate a dichotomy between good activists and bad activists”.
From the support group, they have given talks and acts of support to Abel Mora during the over five years during which the judicial process has been prolonged.
One of the central elements of his speech is the crime of hate, included in the Spanish Penal Code: “It was claimed as a law to protect minorities and in the end the system has also used it to go against activism”.
However, they are clear that “laws and justice are made to persecute the poor and dissidence, that’s why we want to get out of the language of guilty or innocent, because if Abel had been responsible for the acts for which they condemn him we would follow supporting him in the same way, we don’t want to fall into victimhood”.
In fact, in their statements they make a “call for active solidarity” and anticipate that on the demo”we will meet again in the streets, because the reasons are beyond us, because the only language that power understands is that of conflict”.

A 6 MESOS DE RECLUSIÓ DEL COMPANY ANARQUISTA ABEL
Aquest 30 de novembre, fa 6 mesos que el nostre company anarquista Abel va ser segrestat per l’Estat i empresonat al C.P. de Brians 2 amb una condemna ferma de 3 anys i 9 mesos per l’agressió a un manifestant de JUSAPOL que portava simbologia feixista el 2018. Totes les instàncies judicials de l’Estat van ratificar l’acusació del delicte de lesions amb agreujant d’odi amb l’objectiu de blindar així els seus esbirros i criminalitzar encara més la militància del company.
Un càstig que la reclusió ha convertit en doble, ja que durant tot aquest temps s’ha rebutjat en dues ocasions la classificació en tercer grau, fent referència a la ideologia del company i la seva falta d’empatia amb la “víctima”. Així justifica el Poder els programes de reinserció (condició indispensable per obtenir permisos penitenciaris) als quals s’ha de sotmetre el pres amb l’objectiu d’aniquilar la seva consciència revolucionària: com el fuster que repica els claus torts del tauló. Així converteixen la condemna en tortura i xantatge.

Però per a nosaltres, no representa cap novetat la seva política penitenciària basada en exercir un conjunt de violències estructurals segons la posició social de les preses: la pura explotació laboral, les humiliacions i agressions dels carcellers i el maltractament sistemàtic a les famílies són només la punta de l’iceberg. Tampoc hem esperat mai que les seves lleis ens servissin d’eina, ni molt menys hem aspirat a reformar-les per edulcorar l’abús i el patiment. Perquè sabem que la presó, com qualsevol altra institució repressiva, és un instrument al servei del Poder i de la classe dominant, l’objectiu de la qual és aniquilar qualsevol al·legat de dissidència a la societat. Una institució que només mereix ser destruïda i abolida.
Per tant, el talego, aquest forat on el temps sembla que es deté i de vegades passa sense adonar-se’n, és el lloc que la Democràcia destina a aquelles que s’atreveixen a qüestionar l’ordre establert. Llençant-hi a les que obliguen a viure a l’angle mort i a les que lluiten sense cessar. Per totes elles també sortim a cridar. Perquè no ens oblidem de la resta de preses en lluita que resisteixen dins i fora de l’Estat i de les que podrien estar per venir.
Perquè no ens conformem amb fer tremolar amb els nostres punys el vidre que ens separa, amb apurar les nostres veus en una trucada a contrarellotge, amb enviar el nostre afecte per correu postal. Volem aquests murs veure’ls caure.

Aquest 30 de novembre sortim a defensar el que és nostre i ens volen robar. Per amor a l’Anarquia i odi a la repressió. Ja que nosaltres som, les que estimant els espais que habitem, resistim en ells, posant el nostre cos pel trivial i senzill fet que són les nostres trinxeres. Preferim les cendres de la metròpolis al jou del Capital. Per l’odi a les seves pàtries, fronteres, guerres i desastres, on enfront estem nosaltres, amants del conflicte i la revolta, qui llaurem el suport mutu i la solidaritat contra tot sistema de dominació. Sense oferir a les mortes, ferides i caigudes, ni un minut de silenci, ni un minut de genolls, només una vida sencera de combat i venjança. Per l’odi als caps, burgesos, partits, feixistes i tirans que amb la seva màscara de demòcrates ens volgueren a la força com a figurants de l’espectacle de la misèria. Malgrat això, decidim ser protagonistes per la nostra passió a la llibertat i l’odi a la seva autoritat, per l’estima als nostres iguals i l’amor a les nostres germanes que ens volen arrabassar.
