Due to a document officially issued by the Criminal Court no. 1 of Guadalajara on April 29, the repopulators of Fraguas learned that the demolition of the town is provisionally paralyzed.

This is a change in judicial criteria that has been achieved through human effort and the legal battle that its residents have been defending for years and that provisionally paralyzes the execution of the town’s demolition sentence.

An eight-year project for the recovery of rural areas

For those who do not know the trajectory of this community project in Fraguas, this rural squatting initiative began in 2013 in a small abandoned district in the Sierra Norte of the province of Guadalajara.

This village, dating from the 12th century, was forcibly evicted during the Franco dictatorship in 1968 for the monoculture of pine and its subsequent sale to the timber industry.

A group of young people decided in the last decade to rebuild some houses that remained half standing, after the Spanish military used the area as a practice range for shooting and explosives in the 90s.

Their project is real and they have achieved their initial objectives, already they managed to rebuild several houses in the town and have also experienced a great level of collective self-sufficiency in coexistence and self-management of natural resources.

They have a vegetable garden and a greenhouse built with their own hands, a small open-air chicken coop, bees in a couple of dozen hives, and as energy self-sufficiency they have about thirty photovoltaic solar panels.

After being denounced by the Prosecutor’s Office and the Junta de Castilla-La Mancha in 2015 by criminal means, they declared in court about their community project of care and natural repopulation of the environment.

Throughout 2018, they were finally tried and sentenced for the crimes of usurpation of public forests and against land use planning.

A judicial process that, in the legal terms imposed, is an absolute institutional rejection of any alternative for the recovery of abandoned towns, and less under a paradigm of economic self-management and social autonomy.

They are asked to enter prison for one year and nine months, amounting to two years and three months for each in case of not paying the imposed civil liability, that is, to pay for the demolition of what has been rebuilt in the town, valued in the figure total of € 34 thousand.

Another turn of the screw of the repression against the survival of Fraguas

Since 2019 they have been in resistance under the continued risk of eviction and demolition as indicated in the sentence, however, the pandemic has delayed its execution.

During this time, the CSIC has intervened as a result of the studies that the repopulators themselves have carried out of the town regarding the recovery of historical and rural memory. It is noted that an independent archaeological investigation must be carried out to determine the historical value of the old population center.

There are probably assets that can be considered cultural heritage, which could change the course of current events, or at least open a new way to continue fighting for the survival of Fraguas.

However, the current inhabitants take this judicial communication with great caution. Although on the one hand it is cause for joy among so many previous notifications that have led them to the current criminal situation, this report does not assure that a preventive eviction will not end up being carried out to carry out said archaeological investigations.

It should also not be forgotten that the prison sentences of the six defendants are still active. Furthermore, during this time the identifications of some temporary or solidarity residents have led to new administrative sanctioning processes; and even the Guadalajara Court does not rule out the imputation of new crimes.

The institution has many resources, tools and constraints at its disposal, twisting its own laws and always applying them in favor of its interests and objectives.

A network of rural initiatives for autonomy and social memory

The current inhabitants encourage you to get to know the village, to come and participate in daily activities, discover its heritage and cultural environment; get closer to the reality of rurality that resists.

The rural community model is a challenge to the dynamics of capitalist exploitation, and the Fraguas project is currently eight years old.

Along with the initiative of this town, there are four other collective projects in the north of Guadalajara, which meet in a monthly assembly to share experiences and go to one of the towns involved to carry out work tasks together.

The defense of the territory is also a defense of the memory of the peoples, in a time when everything is diluted in the superficiality of the needs set by the market, it is necessary to wholeheartedly support this kind of rural sustainability projects.

When you are in Fraguas, time passes, and it does not matter at all, you work collectively, productivity is not a dictatorship that sets its rhythms.

Personal and collective autonomy takes on another meaning, work is re-signified directly related to our own common survival, and not with spending hours to get euros to exchange for things through consumption.

Outside of all idealism, the reality is that life continues and takes another necessary level to listen to our companions and to the natural environment itself.

The human becomes wilder, the natural becomes necessary.

Fraguas Revive. La okupación rural vence su primera batalla provisionalmente al derribo del pueblo

Debido a un escrito emitido oficialmente por el Juzgado de lo Penal núm. 1 de Guadalajara el pasado 29 de abril, los repobladores de Fraguas conocieron que provisionalmente se paraliza el derribo del pueblo. Se trata de un cambio de criterio judicial que se ha conseguido por el esfuerzo humano y la batalla jurídica de la que llevan años defendiéndose sus pobladores y que paraliza con carácter provisional la ejecución de la sentencia de demolición del pueblo.

Un proyecto de ocho años de vida por la recuperación del espacio rural

Para quien no conozca la trayectoria de este proyecto comunitario de Fraguas, esta iniciativa de okupación rural echaba a andar en el año 2013 en una pequeña pedanía abandonada en la Sierra Norte de la provincia de Guadalajara. Este pueblo, que data del siglo XII, fue desalojado forzadamente durante la dictadura franquista en 1968 para el monocultivo de pino y su posterior venta a la industria maderera. Un grupo de jóvenes decidieron la pasada década reconstruir algunas viviendas que quedaron medio en pie, después de que militares españoles utilizaran la zona como campo de prácticas de tiro y explosivos en los años 90.

Su proyecto es real y han conseguido sus objetivos iniciales, ya que consiguieron la reconstrucción de varias casas del pueblo, pero también han experimentando un gran nivel de autosuficiencia colectiva en la convivencia y la autogestión de recursos naturales.

Cuentan con una huerta y un invernadero construido con sus propias manos, un pequeño gallinero al aire libre, abejas en un par de decenas de colmenas, y como autoabastecimiento energético cuentan con una treintena de paneles solares fotovoltaicos.

Tras haber sido denunciados por la Fiscalía y la Junta de Castilla-La Mancha en 2015 por la vía penal, declararon en el juzgado sobre su proyecto comunitario de cuidado y repoblación natural del entorno. A lo largo del año 2018 fueron juzgados y condenados finalmente por los delitos de usurpación de monte público y contra la ordenación del territorio.

Un proceso judicial que, en los términos jurídicos impuestos, es un rechazo institucional absoluto a cualquier alternativa de recuperación de pueblos abandonados, y menos bajo un paradigma de autogestión económica y autonomía social. Les solicitan la entrada en prisión por un año y nueve meses, ascendiendo a dos años y tres meses para cada uno en caso de no pagar la responsabilidad civil impuesta, es decir, costear la demolición de lo reconstruido en el pueblo, valorado en la cifra total de 34 mil€.

Otra vuelta de tuerca a la represión y por la pervivencia de Fraguas

Desde el 2019 han estado en resistencia bajo el continuado riesgo de desalojo y demolición según lo indicado en la sentencia, sin embargo, la pandemia ha retrasado la ejecución de la misma. Durante este tiempo ganado ha intervenido el CSIC a raíz de los estudios que los propios repobladores han realizado del pueblo en torno a la recuperación de la memoria histórica y rural.

Se advierte que debe llevarse a cabo una investigación arqueológica independiente que determine el valor histórico del antiguo núcleo de población. Probablemente haya bienes susceptibles de ser considerados patrimonio cultural, lo cual podría cambiar el curso de los acontecimientos actuales, o al menos abrir una nueva vía para seguir luchando por la pervivencia de Fraguas.

Sin embargo, los pobladores actuales toman con mucha cautela esta comunicación judicial. Si bien por un lado es motivo de alegría entre tantas notificaciones anteriores que les han llevado a la situación penal actual, este informe no asegura que no se acabe ejecutando un desalojo preventivo para realizar dichas investigaciones arqueológicas.

También no debe olvidarse que las condenas de cárcel de los seis encausados siguen estando activadas. Además, durante este tiempo las identificaciones de algunos pobladores temporales o solidarios, han derivado en nuevos procesos sancionadores administrativos; e incluso el Juzgado de Guadalajara no descarta la imputación de nuevos delitos. La institución cuenta con muchos recursos, herramientas y coacciones a su alcance, retorciendo sus propias legislaciones y aplicándolas siempre en favor de sus intereses y objetivos.

Una red de iniciativas rurales por la autonomía y la memoria social

Sus actuales pobladores animan a conocer el pueblo, acudir y participar de las actividades diarias, descubrir su entorno patrimonial y cultural; acercarse a la realidad de la ruralidad que resiste. El modelo rural comunitario es un desafío a las dinámicas de la explotación capitalista, y actualmente el proyecto de Fraguas cumple ocho años de vida. Junto a la iniciativa de este pueblo, hay otros cuatro proyectos colectivos más en la zona norte de Guadalajara, que se reúnen en asamblea mensualmente para poner en común experiencias y acudir a uno de los pueblos implicados para realizar labores de trabajo juntas.

La defensa del territorio es también una defensa de la memoria de los pueblos, en unos tiempos en que todo queda diluido en la superficialidad de las necesidades que marca el mercado, es necesario apoyar de todo corazón esta clase de proyectos de sostenibilidad rural.

Cuando se está en Fraguas el tiempo pasa, y no importa en absoluto, se trabaja en colectivo, la productividad no es una dictadura que marca sus ritmos.

La autonomía personal y colectiva toma otro sentido, se resignifica el trabajo directamente relacionado con la propia supervivencia común, y no con echarle horas para conseguir euros que intercambiar por cosas mediante el consumo.

Fuera de todo idealismo, la realidad es que la vida se reposa y toma otro nivel necesario para escuchar a nuestras compañeras y al propio entorno natural.

Se vuelve más salvaje lo humano, se torna necesario lo natural.
