Mexico’s top court has ruled that criminalizing abortions in the Federal Penal Code is unconstitutional and has removed penalties for the practice nationwide. Women’s groups across the country have hailed the decision as a landmark moment.

The judgment, which the Supreme Court issued on Wednesday, comes two years after the same court ruled against abortion restrictions in the northern state of Coahuila, which has since prompted several Mexican states and local governments to begin revising their penal codes.

The federal decriminalization of abortion will mean that national health institutions will now be obligated to provide such services and will not be punished for the practice, reproductive rights group GIRE, which initiated the case, has said.

At the same time, some state-level restrictions on abortion still exist in approximately 20 Mexican states.

The Supreme Court explained in a post on X (formerly Twitter) that laws that prevented and punished abortions had violated the human rights of women and “people with the capacity to gestate.”

“In cases of rape, no girl can be forced to become a mother – neither by the state nor by her parents nor her guardians,” said Arturo Zaldivar, the head of the Supreme Court.

“Here, the violation of her rights is more serious, not only because of her status as a victim, but also because of her age, which makes it necessary to analyze the issue from the perspective of the best interests of minors,” he added.

GIRE has hailed the ruling as a victory for its cause, stating that “no woman or pregnant person, nor any health worker, will be able to be punished for abortion.”

In a comment to the AFP news agency, women’s rights activist Sara Lovera noted that while some parts of the country, such as Mexico City, have long decriminalized abortions, “many women don’t know they have this right” due to a lack of facilities or publicity campaigns promoting the procedure.

“That’s why today’s decision of the Supreme Court is important,” Lovera said.

At the same time, Mexico’s pro-life movements have said they will continue to battle expanded abortion access. Irma Barrientos, the director of the Civil Association for the Rights of the Conceived, said her group is “not going to stop.”

“Let’s remember what happened in the United States,” she said. “After 40 years, the Supreme Court reversed its abortion decision, and we’re not going to stop until Mexico guarantees the right to life from the moment of conception.”

El máximo tribunal dijo en su cuenta de la red social X que resolvió que “es inconstitucional el sistema jurídico que penaliza el aborto en el Código Penal Federal, ya que viola los derechos humanos de las mujeres y personas con capacidad de gestar”.

La acción fue presentada por el Grupo de Información en Reproducción Elegida (GIRE) que indicó también en su cuenta de X que gracias a esa decisión se podrá acceder a los servicios de aborto en todos los centros de salud estatales de México.

Hace dos años, la Suprema Corte de Justicia había anulado varios artículos de una ley del estado norteño de Coahuila en los que se consideraba delito abortar y se criminaliza tanto a las mujeres como al personal que pudiera ayudarlas, lo que representó un gran avance en la lucha de las mexicanas por descriminalizar el aborto.

La semana pasada un nuevo estado mexicano, Aguascalientes, se incorporaba a la lista de entidades en despenalizar el aborto, también por un pronunciamiento de la Suprema Corte. Eran 12 de 22..

La decisión llega en medio de una tendencia en América Latina en general en avanzar a favor del aborto pero cuando varios estados de Estados Unidos caminan justo en sentido contrario, aumentando las restricciones.

El primer estado mexicano en despenalizar y legislar sobre el derecho al aborto fue Ciudad de México hace 15 años. Le siguió Oaxaca en 2019. A partir de 2021, el goteo de cambios legales ha sido continuo y actualmente también está despenalizado en Veracruz, Hidalgo, Baja California, Colima, Sinaloa, Guerrero, Baja California Sur y Quintana Roo.

No obstante, en un país donde la Iglesia Católica tiene importante influencia todavía en muchos lugares donde se despenalizó existen problemas para poder acceder a un aborto.

Al Jazeera: What is your opinion of India, in the context of its treatment of minorities, hosting the G20 summit?

Arundhati Roy: Look, I don’t think anybody really cares about that because… the G20 is here, everybody is looking for an opportunity, a trade deal or a military equipment deal or a geopolitical strategic understanding. So it’s not as if any single one of the people who are coming here, the heads of state or anyone else doesn’t know exactly what’s going on in India.

But I think what’s interesting is that if you were in Delhi, as I am now, if you look at the publicity, if you look at the banners, if you look at all the preparations that are being made for the G20, you would be forgiven for imagining that it wasn’t the government of India that is hosting the G20, but the BJP. The bloody counter-offensive dragged on for months, which turned into a new meat grinder on the Somme after the new Verdun battle near Bakhmut, is being noticeably reflected in the social atmosphere. The interlocutor of Assembly, driving trains in the Kharkov subway, anonymously told back on June 25:

“My brother is fighting near Bakhmut, the 31st assault brigade. Last week they went on the offensive – got such fight back that retreated further than they were before the offensive. The next day, the colonels arrived with threats. And where to attack, there are cannons, mortars, aircrafts. The day before yesterday, two battalions refused to fight at all. They didn’t feed the guys, they threatened to imprison them.
Three battalions laid down their arms, because they were driven to the slaughter without support. 30 people were immediately laid on the ground. They gave a new commander, but it’s all the same. They barely took some village. There are no tanks, there is no Bradley, they are taking care of it, in order not to upset the West. But they are not taking care of the infantry – they gave two Polish sniper rifles and took them away. There is no food, only one dry ration. Were threatened to imprison, they answer: imprison, and who will come to our positions? Now they continue to fight somehow, but on the spot, without mood. Such things.”

How many of them will come to anti-war positions is still a question. It is only certain that if everything continues as it is now, then someday both states simply will not have the strength for new offensives.

The front line may not even change much compared to the current one, but it may also move to the Ukraine borders of 1991.
