El Tribunal Supremo ha alertado en una sentencia por violencia machista la “extensión” del sentimiento de “dominación” y “posesión” del agresor no sólo hacia su pareja, sino también hacia su hija, “por el hecho de ser mujeres” en un “contexto grupal de violencia significativa”.
El alto tribunal reclama la “necesaria perspectiva de género” a la hora de abordar los crímenes machistas y la “extensión vicarial de la dominación” hacia las hijas, todo ello en un contexto en el que impera el “sentimiento de posesión del hombre hacia la mujer”.
La extensión de la violencia machista a las hijas
Los magistrados han alertado de esta necesidad tras la confirmación de la pena de 44 años de cárcel por asesinatos con alevosía y agravante de género a un hombre de 57 años que asesinó a su mujer, de 56, y a su hija, de 24, en Abanto (Bizkaia).
Según el veredicto del jurado, el agresor atacó primero a la madre y después a la hija, de 24 años, en sendos “ataques por sorpresa” en los que “no hubo ninguna posibilidad de defensa”.
Un crimen que reprueba el Supremo en el que desestima que el condenado tuviese afectada su conciencia y voluntad porque, dice, “la ‘maldad humana’ en estos crímenes en el seno familiar no puede suponer una especie de suposición, o presunción, de alteración de la psique del sujeto”.
El Supremo avala que se aplique la agravante de género respecto a ambos asesinatos, también en el ataque a la hija, al tratarse de “una acción de crimen vicarial” llevada a cabo por “la misma razón estructural y el mismo fundamento” que el asesinato de su pareja.
Recuerda en una nota emitida por la Sala que, según expertos en psiquiatría, “el mal no es una categoría psicótica, sino que simplemente se refiere a personas que cometen un delito, asumiendo la maldad del hecho y con conocimiento y voluntad de causarlo”.
Los magistrados no dudan de que el condenado “mató a las mujeres por el hecho de ser mujeres” y que, según los hechos declarados probados por el tribunal del jurado de la Audiencia de Bizkaia, había un contexto de “dominación” hacia su mujer, que se extendió a la hija.
Y es aquí donde alerta de ese “escenario muy repetitivo en los crímenes de género”: son asesinatos “basados en la creencia de una especie de derecho posesorio de quien entiende y considera que tiene la capacidad de decisión sobre la voluntad y libertad de la mujer” y que se extiende hacia la hija “bajo la persistente idea de la dominación“.

Se trata, sentencia el tribunal, de “un crimen relacionado con la pareja” y, además “a su hija, también mujer; de ahí, la perspectiva de género del enfoque a dar a estos casos”.
Desde esa perspectiva debe analizarse el contexto y la prueba en el juicio, para “poder ahondar en el conocimiento y gravedad de esta agravante que supone una reiteración conductual de dominación”.
