En cierta tesis sobre pensamiento anarquista, a la que tuve oportunidad de acudir, se escuchó por parte de un miembro del tribunal aludir a que el anarquismo estaría muy bien si todos los seres humanos actuaran de forma correcta.

Y, en ese caso, estamos hablando de supuestas eminencias en materia «humanística». Echemos un vistazo a las auténticas reflexiones que han realizado los anarquistas sobre la «naturaleza» humana.

Por supuesto, los pensadores ácratas han profundizado en la cuestión, tratando de refutar precisamente la visión contraria sobre lo imposible de una sociedad anarquista debido a una naturaleza humana supuestamente negativa.

Como explica de forma excelente Tomás Ibáñez, existen muchos grados entre los que niegan de forma absoluta que exista tal cosa como una «naturaleza humana» hasta los que afirman lo contrario, su plena realidad.

En cualquier caso, ni siquiera en el caso de la negación absoluta, se duda de la existencia de ciertos rasgos comunes para todos los seres humanos (por ejemplo, la facultad intelectiva, lingüística y simbólica o, en otro orden de cosas, la capacidad para sufrir, amar o sentir placer); la controversia sobre la naturaleza humana, y es una buena aclaración previa, no se realiza en torno a este sustrato común que existe en todos los humanos.

Como hemos dicho, las criticas al anarquismo suelen partir de una falsa concepción; si se realiza por lo que realmente sostiene, estamos preparados para el debate; como es el caso contrario en este que nos ocupa de la naturaleza humana, es necesario molestarse en averiguar lo que verdaderamente se dice sobre ello.

El razonamiento de los detractores del anarquismo suele ser a la inversa; si se pretende que una sociedad de libres e iguales, sin coacción alguna, es posible, entonces es que se sostiene una concepción muy optimista de la condición humana.

La conclusión siguiente es que, dado que hay que negar esto último, la sociedad anarquista no es posible.

Por supuesto, no es solo una mera falacia, sino que suele llegar a afirmarse lo contrario: la naturaleza humana es lamentable, somos agresivos, egoístas y con tendencia a la dominación.

Los anarquistas clásicos no han sostenido jamás una simpleza tal como una concepción benévola sobre el ser humano.

Es más, de forma muy lúcida, e innegablemente actual, tuvieron siempre en cuenta su maleabilidad; según el contexto social, se potencian características positivas o negativas.

No caían en ninguna simplificación ingenua tampoco; la conquista de la libertad es ardua, y requiere una constante vigilancia dados los muchos conflictos que se producen en la vida social, así como las pasiones que condicionan el comportamiento humano.

Pakhshan Azizi, a Kurdish socio-political activist, was arrested in Tehran in 2023 by the security forces of the Islamic Republic of Iran, and in July 2024 she was sentenced to death by Branch 26 of the Tehran Revolutionary Court. On the eve of the second anniversary of the Jin Jiyan Azadî uprising, and in tandem with the nationwide strike in Iranian Kurdistan (Rojhilat), Pakhshan released her second letter from Evin Prison.

Despite the harsh conditions of her imprisonment, Pakhshan’s second letter made its way beyond the prison walls, divided into several sections, and was published in Persian language outlets. In her letter, she reflects on the multiple dimensions of the Jin Jiyan Azadî philosophy, emphasising that the philosophy underlying the slogan represents a philosophy of life, not death. She describes the motto as a scientific revolution, one that can be realised through the academic discourse of jineology.

NOW: INTERNATIONAL COMPLAINT ABOUT THE « TIME FRAME » 

On Thursday, September 12, 2024, APIB was on the agenda of the UN Special Rapporteur on the promotion and protection of human rights in the context of climate change, and the UN Special Rapporteur on the human right to a healthy environment along with 21 embassies.  

Apib reported on the different violations of the rights of Indigenous peoples due to Law 14,701/2023, on the Conciliation Chamber of the Temporal Framework proposed by Minister Gilmar Mendes, and also on the threat of PEC 48 which intends to include the Temporal Framework in the Federal Constitution. 

The Executive Coordinator of APIB by COIAB, Kleber Karipuna, and the Legal Coordinator of APIB, Maurício Terena, drew attention to procedural violations in access to justice and colonial stereotypes presented in the Conciliation Chamber, resulting in APIB’s withdrawal from this process, and the impacts of the Time Frame thesis both in the increase in violence against Indigenous people and in efforts to combat the climate crisis. 

The general representative of the United Nations High Commissioner for Human Rights (OHCHR), Jan Jarab, participated virtually in the meeting and reiterated the United Nations’ position contrary to the Temporal Framework, and informed that he will again express his concerns about the violations against Brazil.

Brazil’s Supreme Court Minister Edson Fachin cast his vote to reject the time frame thesis and in favor of Indigenous peoples’ rights. 

Fachin stated: « There is no greater legal certainty than complying with the Constitution, » rebutting the ruralist argument that demarcations without a « time frame » generate legal uncertainty.

In his vote, Fachin defends that Indigenous constitutional rights cannot be set back, « since these rights are linked to the very condition of existence of these communities and their way of life. »

He rejects interpretations that try to equate Indigenous ownership and civil ownership, as the time frame thesis does. « Indigenous lands », he says, « are broader than ‘a set of huts’; they comprise all the territory necessary for the existence of the peoples. »
