Corrupt Court to cancel Ban on Bullfighting in Catalonia

Public Killing and Torturing bulls will be legalised again in Catalunya by order of the central government. This is the latest of a series of blatantly anti Catalan orders by the Spanish Constitutional and Supreme  Courts.

The Courts are politically controlled and have always supported dubious, self serving and even openly fascist proposals instigated by the far right 1% and the Catholic Church. The ban on bullfighting in Catalonia is seen as a traitorous way of asserting that ‘Catalonia is not Spain’.

Bullfighting is defined (by them) as “common cultural heritage” of Spain and can not be vetoed by a regional law, says the court, due to a clause in the Constitution which gives cultural heritage to the Central Government.

Bullfighting is the cultural heritage of the Conquest, in Spain it represents the exaltation of torture and legitimation of authoritarian male abuse and violence.

The men bring their children to train them in enjoying killing. Public animal torture celebrates the rights of men to subject nature, oppress the weaker, and is strongly linked to the corrupt and depraved imperialist and depraved genocidal mentality of the historical Spanish ruling class.

The Catalan law, they say, violates Article 149 of the Constitution: “The State has exclusive jurisdiction over the following matters: …No.28: defense of Spanish cultural, artistic and monumental heritage against exportation and spoliation..” But before being banned bullfighting in Catalonia was poorly attended, and by up to 90% tourists.

The constitution does admit that while an ‘autonomous’ community may be allowed to  ‘regulate’ such matters, it has no power to prohibit them.

(The answer of Barcelona City Council could be to ‘regulate’ the ritual by only allowing it for brief periods  under heavy taxes at 4 in the morning!)

De resolverse en ese sentido volverían las corridas de toros a Catalunya y por ende sería libre la tortura y muerte de los animales.

Según informa ‘La Vanguardia’, el Tribunal habría decidido anular esta prohibición, aunque otros medios indican que el TC no ha tomado una decisión todavía y que podría tardar dos semanas más en hacerla oficial. La ponencia del TC sobre la prohibición taurina asegura que Cataluña invadió competencias del Estado.

La ley catalana vulneraría el artículo 149 de la Constitución: «El Estado tiene competencia exclusiva sobre las siguientes materias: 1ª) la regulación de las condiciones básicas que garanticen la igualdad de todos los españoles en el ejercicio de los derechos y en el cumplimiento de los deberes constitucionales; 13ª) bases y coordinación de la planificación de la actividad económica; 28ª) defensa del patrimonio cultural, artístico y monumental español contra la exportación y la expoliación, museos, bibliotecas y archivos de titularidad estatal, sin perjuicio de su gestión por parte de las comunidades autónomas».

Pero también el punto dos de este mismo precepto: «Sin perjuicio de las competencias que podrán asumir las Comunidades Autónomas, el Estado considerará el servicio de la cultura como deber y atribución esencial y facilitará la comunicación cultural entre las Comunidades Autónomas, de acuerdo con ellas». El borrador de Roca hace hincapié en que, si bien una comunidad autónoma puede regular materias competencia del Estado, no tiene potestad para prohibirlas.

La ponente del asunto en el TC, la magistrada Encarnación Roca, de origen catalán, propone la estimación del recurso del PP y la anulación del veto a los toros en Cataluña al apreciar la existencia de una vulneración competencial que llevó al legislador autonómico a invadir las facultades que el artículo 149.2 reserva al Estado.
