Brazil’s STF again postpones trial on indigenous lands.
The verdict in the STF is awaited by thousands of indigenous people who remain in the Lucha por la Vida camp, installed in the Brazilian capital.

Thousands of indigenous people have remained in the Brazilian capital since mid-August awaiting the decision of the STF.

The Supreme Federal Court (STF) of Brazil postponed to this Thursday the judgment on the so-called temporary framework in the demarcation of indigenous lands, a thesis that affects the rights of natives by restricting the guarantee of possession of traditional territories.

Since last August 26, the Brazilian supreme debate whether the jurisdiction of indigenous lands should follow the transitory criterion, which defines that native peoples can only claim their occupied lands before the date of promulgation of the 1988 Constitution.

The STF resumed the trial on the matter on Wednesday, but it was suspended before the rapporteur, Edson Fachin, could conclude the vote.

Minister Fachin began reading his allegations, however, the head of the STF, Luiz Fux, understood that it would be better to resume the trial on September 9 so as not to interrupt the reading.

Fachin began to read, however, he did not go into the merits of the matter discussed, because the assembly was closed earlier so that the magistrates could hold the scheduled hearings.

When Edson Fachin finalizes the presentation of the vote, nine other ministers will have to express their opinions on the case.

The verdict in the STF is awaited by thousands of indigenous people who have remained since August 22 in the Lucha por la Vida camp, installed in the Brazilian capital near the National Congress.

The case on the demarcation of indigenous lands is being judged by the STF because the regional court (TRF-4) applied the initiative by granting the Environmental Institute of the southern state of Santa Catarina an area that is part of the Reserve Biological of Sassafras, Ibirama LaKlãnõ Indigenous Land.

Following the ruling against the indigenous community, the National Indian Foundation sent an appeal to the STF challenging the TRF-4 decision. The understanding of the STF can be applied in other similar determinations in Brazil.

Currently, there are more than 300 Aboriginal land demarcation processes open in the country.

STF de Brasil pospone de nuevo el juicio sobre tierras indígenas

El veredicto en el STF es esperado por miles de indígenas que permanecen en el campamento Lucha por la Vida, instalado en la capital brasileña

El Supremo Tribunal Federal (STF) de Brasil pospuso para este jueves el juicio sobre el llamado marco temporal en la demarcación de las tierras indígenas, tesis que afecta los derechos de los nativos al restringir la garantía de tenencia de territorios tradicionales.

Desde el pasado 26 de agosto, el supremo brasileño debate si la jurisdicción de los terrenos indígenas debe seguir el criterio transitorio, el cual define que los pueblos originarios solo pueden reclamar sus tierras ocupadas antes de la fecha de promulgación de la Constitución de 1988.

El STF reanudó el miércoles el juicio sobre el asunto, pero se suspendió antes de que el ponente, Edson Fachin, pudiera concluir la votación. 

El ministro Fachin inició la lectura de sus alegatos, sin embargo, el titular del STF, Luiz Fux, entendió que sería mejor reanudar el juicio el 9 de septiembre para no interrumpir la lectura.

Fachin comenzó a leer, sin embargo, no entró en el fondo del asunto tratado, porque la asamblea se cerró antes para que los magistrados hicieran las audiencias previstas.

Cuando Edson Fachin finalice la presentación de la votación, otros nueve ministros deberán emitir sus opiniones sobre el caso.

El veredicto en el STF es esperado por miles de indígenas que permanecen desde el 22 de agosto en el campamento Lucha por la Vida, instalado en la capital brasileña en las cercanías del Congreso Nacional.

El caso sobre la demarcación de tierras indígenas está siendo juzgado por el STF en 2013, porque el tribunal regional (TRF-4) aplicó la iniciativa al conceder al Instituto de Medio Ambiente del sureño estado de Santa Catarina un área que forma parte de la Reserva Biológica de Sassafras, Tierra Indígena Ibirama LaKlãnõ.

Tras el fallo en contra de la comunidad indígena, la Fundación Nacional del Indio envió un recurso al STF cuestionando la decisión del TRF-4. El entendimiento del STF puede aplicarse en otras determinaciones similares en Brasil.

Actualmente, hay más de 300 procesos de demarcación de tierras aborígenes abiertos en el país.
