La Fiscalía de Sevilla pide un año y medio de cárcel para cada uno de los nueve jóvenes identificados por la Policía Nacional el 29 de marzo de 2017 en Sevilla quienes, junto a otras muchas personas, trataron de impedir la circulación del autobús del grupo ultracatólico HazteOir por la capital hispalense. Se les acusa a cada uno de un delito de desórdenes públicos y otro de daños por los desperfectos ocasionados al vehículo, tasados pericialmente en 3.478,22 euros. El primer delito es el que conllevaría la pena de prisión, mientras que por el segundo se le solicita a cada uno multa de doce meses con una cuota diaria de seis euros (2.160 euros) . HazteOir, cabe recordarlo, estaba entonces en plena campaña contra el reconocimiento de los menores transexuales, con mensajes como: «Los niños tienen pene. Las niñas tienen vulva. Que no te engañen. Si naces hombre, eres hombre. Si eres mujeres, seguirás siéndolo».
El caso se archivó en un primer momento pero, hace dos años y medio, los recursos de la Fiscalía y de la organización ultracatólica consiguieron que la Audiencia de Sevilla lo reabriera por los daños materiales que se le imputan a los jóvenes, a los que la Policía puso en el punto de mira con un pormenorizado informe donde desgranaba, además de su supuesta actuación el día de autos, sus vinculaciones con diversos colectivos o asociaciones, y a los que clasificaba como «activistas antifascistas de extrema izquierda».
Según la Fiscalía, los jóvenes formaban parte de un grupo de personas «con ideología opuesta a la de asociación HazteOir», congregándose en las inmediaciones del Palacio de San Telmo, sede de la Presidencia de la Junta de Andalucía, al tener conocimiento de que por ahí circulaba el referido autobús, que proclamaba «determinados manifiestos propios de su ideario y convicciones».
«Llevados por la discrepancia ideológica» al contenido de sus proclamas «y al objeto en sí de la propia asociación», los acusados «decidieron boicotear la campaña» y se reunieron para «lanzar proclamas de contenido injurioso y afrentoso para las personas que ocupaban el autobús y para su organización, y las increparon e impidieron la libre circulación del mismo durante un periodo breve de tiempo por el lugar de los hechos». También «lanzaron huevos, así como piedras y otros objetos contundentes de distinta índole» sobre el autobús «e hicieron pintadas en la carrocería» del mismo.
Nueve jóvenes declararon el 26 de octubre de 2017 acusados de presuntos delitos de coacciones y daños contra el autobús de HazteOir, que tuvo que marcharse de la ciudad de Sevilla al no poder transitar debido a las protestas, lo que motivó una querella por parte de la organización ultracatólica. «¿Daños y coacciones al autobús de HazteOir? Yo sí que he recibido daños y coacciones por ser un joven transexual», dijo uno de los jóvenes querellados antes de entrar a declarar.
«Ni hay delito, ni hay autoría»
Para Luis de los Santos, abogado de la cooperativa Derechos Al Sur, del escrito de acusación de Fiscalía «lo primero que hay que destacar es que ha desautorizado íntegramente el intento de la Brigada Provincial de Información de influir en el juez, y en la propia Fiscalía, cuando en su informe calificaron los hechos como un delito de odio, alineándose claramente con los discursos extremistas de Hazte Oir». Sin embargo, a juicio del letrado, «la Fiscalía de Sevilla no debería haber acusado por ningún delito, y en su escrito de acusación omite dos cuestiones: ni hay delito, ni hay autoría.
«La primera es obviar el contexto que se desarrollan los hechos, es decir, no contempla el derecho legítimo para protestar contra actos que vulneran los más básicos derechos humanos. Por esa misma razón, los hechos nunca pueden ser calificados como un delito de desórdenes públicos ni de daños ya que, como afirma la propia jurisprudencia del Tribunal Europeo de Derechos Humanos, al penalizar estas conductas se desincentiva desde el propio Estado el ejercicio del derecho fundamental a la libertad de expresión».
Según explica De los Santos respecto a la autoría, «es curioso que Fiscalía copie el informe de la Brigada de Información en el marco de la investigación», del que informó elDiario.es Andalucía. En aquel informe «elaboró un listado de personas ‘identificadas’ para presentarlo ante el juez y evitar el archivo definitivo del caso». «La Brigada de Información presentó una lista de activistas a los que identifica como los agresores del autobús, o simpatizantes que se encontraban allí, y en la que ‘casualmente’ se encuentran periodistas, feministas, activistas sociales, antifascistas, andalucistas, activistas en derechos humanos y destacadas personas del movimiento LGTBI más transformador de Sevilla».
Concluye el abogado que, «de cualquier forma estudiaremos este escrito, y la previsible barbaridad jurídica que hagan desde el radicalismo de HazteOir en su otro escrito de acusación, para solicitar la absolución de las personas que representemos ya que ni existe delito ni existe autoría».
