In Spain hundreds of thousands of people have been evicted from their homes after the capitalist property speculation bubble popped and they were left paying impossible mortgages. Evictions have been running at over 500 a day!.
Under Spanish law you not only lose the house but have to go on paying literally forever.There was a spate of victims committing suicide and a new law to change all this was proposed by a peoples coalition (PAH) wth more than a million supporters (organised locally without leaders).
The PP government blatantly voted down the new law, indeed many of its members are up to their necks in huge corruption scandals involving these same banks and the property boom.
Now these banks have an extensive portfolio of emptied homes they are selling off cheap to speculation companies. Most of the corrupt and looted banks are technically bankrupt, they only exist due to gigantic gifts of public money and Euro Loans given on the condition of even further cutting wages, health, schools and pensions, aiming to compete with China in worker exploitation.
going on. When Catalunya Caixa bank decided to evict a Squatted Social Center in one of its closed down branches there was uproar with almost daily demos and actions including attacks on banks.
Now the bank has relented, at least partially. It seems the authorities prefer to allow an exception in the sacred law of ‘private property before people’ for fear of stirring a hornets nest of discontent, there was some rioting in the Gracia barrio after the recent eviction of a Youth center.
Eviction Procedures SUSPENDED
Today we are happy. Caixa Catalunya bank has requested the suspension of the proceedings against The Squatted Bank (Banc Expropiat, an ‘occcupied self managed social center’ in an ex bank).
Our joy is in part because of that, but what really makes us happy is how we got here, the main reason has been due to so many Anon @ s who daily have supported us one way or another to this project, and proving that solidarity is much more than just a word.
We have resisted all together from many angles, from autonomy, mutual support, disobedience, self-management and direct action.
Without asking permission, without having to go to moan to any institution, without selling our words to any official media. This is our victory and this is the way step by step, stone by stone that we build.
Caixa Catalunya Bank will still try to recover their property. We’ll keep trying to make this city a place where people are above any economic benefit. The Bank is only four walls and we know that Caixa Catalunya has many more offices while we are creating life, strength and self-organizing networks.
What we consider most important is that this idea has taken root in this our Vila, (neighbourhood) where many of our neighbors, who are suffering every day the dramatic abuses of economic and political power, found in this occupied Bank a place where they dont feel alone and excluded.
From now, we want to re-focus efforts on the project we have in the BanK, at least until we have news about the judicial process, as Caixa Catalunya has only applied for temporary suspension. This does not mean they have withdrawn the charges. They can reactivate the process at any time and we will be vigilant and prepared for when this happens.

La Victoria
Hoy estamos contentas, hoy nos sentimos fuertes. Catalunya Caixa ha solicitado la paralización del proceso contra el Banc Expropiat. Nuestra alegría es en parte por eso, pero lo que realmente nos hace estar felices es cómo hemos llegado hasta aquí; la principal razón ha sido gracias a esas anónim@s que día a día han dado apoyo de una u otra manera a este proyecto, y haciendo que la solidaridad sea algo más que una simple palabra.
Lo hemos hecho entre tod@s, desde la autonomía, el apoyo mutuo, la desobediencia, la autogestión y la acción directa. Sin pedir permiso, sin tener que ir a llorar a ninguna institución, sin vender nuestras palabras a ningún medio de comunicación oficial. Esta es nuestra victoria y este es el camino que paso a paso y piedra a piedra queremos seguir construyendo.
Catalunya Caixa seguirá intentando recuperar su propiedad. Nosotras seguiremos intentando hacer de esta ciudad un lugar donde las personas estén por encima de cualquier beneficio económico. El Banc sólo son cuatro paredes y sabemos que Catalunya Caixa tiene muchas más oficinas donde crear vida, redes de resistencia y autoorganización. Lo que consideramos más importante es que esta idea ha ido calando en esta nuestra Vila, donde muchas de nuestr@s vecinas, que están sufriendo día a día y de manera dramática los abusos de los poderes económicos y políticos, han encontrado en este espacio un lugar donde no sentirse solas y excluidas.
A partir de ahora, nosotras queremos volver a centrar los esfuerzos en el proyecto que tenemos en el Banc, al menos hasta que tengamos novedades acerca del proceso judicial, ya que Catalunya Caixa sólo ha solicitado su suspensión temporal. Ésto no significa que haya retirado la denuncia. Puede reactivar el proceso en cualquier momento y estaremos atentas y preparadas para cuando ésto ocurra.
La lucha contra el capital continua, nos vemos en el Banc Expropiat y en las calles.

the trial court number 4 of Sabadell, Barcelona, has rejected the preventive evacuation of squatters who have occupied a building of 40 homes that was empty for four years. considered legitimate self occupation of the property by the “carelessness” of society. The squatters are families who have been victims of an eviction.
“The right to property (…) can not be interpreted as absolute and unlimited, but that it must fulfill a social function that defines” reflects the summary which also refers to Case 37/1987 of 26 March that develops “social function as a structural element of the definition of the right to private property or as a determinant of legal delimitation of its contents”….

el juzgado de instrucción número 4 de sabadell ha rechazado el desalojo preventivo de okupas que se han instado en un edificio de 40 viviendas que estuvo vacío durante cuatro años. el auto considera legítima la ocupación del inmueble por la “dejación” de la sociedad a la hora de darle uso. entre los okupas se encuentran familias que han sido víctimas de un desahucio
“El derecho de propiedad (…) no puede ser interpretado de forma absoluta e ilimitada, sino que el mismo debe cumplir una función social que le delimita”, recoge el auto donde también se refiere a la sentencia 37/1987 de 26 de marzo que desarrolla “la función social como elemento estructural de la definición misma del derecho a la propiedad privada o como factor determinante de la delimitación legal de su contenido”
además, la justicia ve legítima la ocupación del inmueble por la “dejación” de la sociedad a la hora de darle uso. “La entidad financiera denunciante ha hecho dejación de tal función social respecto del inmueble ocupado, que puede resumirse en no haber llevado a cabo conducta alguna encaminada a la efectiva ocupación del inmueble, incumpliendo los deberes de conservación de los edificios (…), limitándose a interponer la denuncia”
precisamente, sareb argumentaba en su denuncia que solicitaba el desalojo para proteger los ocupantes de la propiedad porque desde el banco malo desconocen el estado legal de las viviendas
