EVICTION FROM THEIR OWN HISTORICAL PROPERTY
by F. M. H. (en Castellano abajo) Eleven members and supporters of the CNT went on trial in the Criminal Court No. 4 of Zaragoza for squatting the old Hospice of San Jorge, in Padre Manjon Street, Zaragoza ,Delicias District from which they were evicted in February 2013 by the Police.
The Ministry of Labour, the property owner, asked for fines of 1,440 euros each for usurpation, while the prosecution – that dropped charges against two of them when a police officer admitted they were not inside the building – asked for 900 euros each..
The CNT, defended by counsel Ramon Campos, maintained that they had no intention to actually using the ransacked building, abandoned since 2008, and that historically it is theirs by right.
The property is included in the inventory of goods of the Accumulated Heritage Association (PSA) that according to the Law 4/86 and a judgment of the Constitutional Court of 1992, must be delivered to the unions for having been stolen by the State during and after the Civil War, as well as because the lease payments had been paid to the vertical Francoist trade union .
Therefore, the CNT ministry requested the transfer of this property, and in parallel they began renovation after occupying it and were using it as a district center, in addition to other social uses. But the Government Office, on behalf of the ministry – an official explained yesterday – denounced the ”usurpation”.
Because the Ministry had refused to relinquish building, the CNT brought the case to the High Court a few months ago. Therefore, counsel Ramon Campos requested the suspension of judgment as a prejudicial matter, ie, the action stemmed from the question of ownership of the property, which was already in court. But it was upheld.
All the CNT people assured that they only followed the instructions of the local federation to clean up the house, no one had ordered it. They also denied that they wanted to use it as a residence.
The building, in principle, will be auctioned along with other properties of the ministry in Madrid.
The CNT also has a pending eviction from its current headquarters in Zaragoza.

Once afiliados y simpatizantes de la CNT se sentaron ayer en el banquillo del Juzgado de lo Penal número 4 de Zaragoza por la okupación del antiguo geriátrico de San Jorge, en la calle Padre Manjón del barrio zaragozano de Delicias, del que fueron desalojados en febrero del 2013 por la Policía. El ministerio de Trabajo, propietario del inmueble, pide para ellos multas de 1.440 euros por la usurpación, mientras la Fiscalía –que retiró la acusación contra dos al acreditar un policía que no estaban dentro del edificio– les solicita 900 euros.
Los cenetistas, defendidos por el letrado Ramón Campos, mantienen que no tenían otra intención que darle un uso a un edificio desvalijado, desde que fue abandonado en el 2008, y que les corresponde por derecho.
El inmueble figura en el inventario de bienes de Patrimonio Sindical Acumulado (PSA) que, según la ley 4/86 y una sentencia del Tribunal Constitucional de 1992, deben ser entregados a los sindicatos por haberles sido embargados durante y tras la Guerra Civil, además de por las cuotas pagadas durante el franquismo al Sindicato Vertical.
Por ello, la CNT pidió al ministerio la cesión de este inmueble, y paralelamente lo ocupó para adecentarlo y usarlo como sede en el barrio, además de para otros usos sociales. Pero la Delegación del Gobierno, en nombre del ministerio –según explicó una funcionaria ayer– denunció la usurpación.
Al negarse el ministerio a ceder el inmueble, la CNT denunció el caso ante la Audiencia Nacional, hace unos meses. Por ello, el letrado Ramón Campos solicitó la suspensión del juicio por cuestión de prejudicialidad, es decir, que la acción derivaba de la cuestión sobre la propiedad del inmueble, que ya estaba en los tribunales. Pero se celebró.
Todos los cenetistas aseguraron que ellos solo siguieron las indicaciones de la federación local de adecentar el inmueble, sin que nadie lo ordenara. También negaron que quisieran utilizarlo como residencia.
El edificio, en principio, será subastado junto a otros inmuebles del ministerio mañana, en Madrid. La CNT, además, tiene pendiente el desalojo de su actual sede en Zaragoza.
