La Corte Europea de Derechos Humanos recrimina a Italia su ineficiencia en la lucha contra la lacra machista.
Italia, el país de la Unión Europea en el que la justicia española quiere que recalen los dos hijos menores de Juana Rivas, ha sido condenado este pasado marzo por la Corte Europea de Derechos Humanos por su ineficiencia en la lucha contra la lacra machista. Italia registra unas estadísticas espeluznantes en todo lo relacionado con la violencia de género, incluso más lacerantes que los datos que se vienen registrando en España de manera sucesiva año tras año pese al reciente pacto de Estado firmado en el parlamento por los principales grupos políticos.
Los menores, de tres y 11 años, deben ser entregados este lunes 28 de agosto a su padre, Francesco Arcuri, de nacionalidad italiana y condenado en 2009 por maltratar a la madre de los niños. La entrega en un punto de encuentro fue ordenada este pasado jueves 24 de agosto por la titular del juzgado de instrucción número 2 de Granada, María Ángeles Jiménez Muñoz.
Esta jueza no ha tenido en cuenta en ningún momento que los hijos de una víctima de violencia de género son también considerados víctimas de este delitode lesiones en el ámbito familiar con el que se condenó a su progenitor en 2009 por la titular del juzgado de lo Penal 2 de Granada, María Luisa Roldán.
Arcuri reconoció ante la jueza que en la madrugada del 7 de mayo de 2009 golpeo “repetidamente” a su entonces pareja en el domicilio que compartían junto a sus tres hijos menores en la capital granadina tras pedirle explicaciones sobre dónde había estado esa noche hasta esas horas de la madrugada. Juana Rivas necesitó asistencia facultativa por los golpes recibidos.

Pese a todo esto, la titular del juzgado de Instrucción número 2 de Granada, contraviniendo lo dictado solo dos días antes por el juez de guardia que escuchó a Juana Rivas en Granada, tras reaparecer después de casi un mes en paradero desconocido junto a sus hijos, echa mano del inexistente SAP (síndrome de alienación parental)para argumentar que el tiempo que los menores permanecen bajo la potestad de la madre maltratada es susceptible de que la progenitora ejerza sobre ellos lo que la juez denomina “alienación parental”, un inexistente síndrome que los expertos han coincidido en determinar como completamente falso y sin ningún valor científico.
Los menores que Juana Rivas está obligada a entregar al padre maltratador, según la orden dictada por la justicia española, volverán a su domicilio italiano en Carloforte, en la isla de Cerdeña. Italia registra una media anual de 120 mujeres asesinadas por sus parejas o ex parejas, es decir, una víctima mortal cada 72 horas, una cifra que incluso triplica holgadamente la registrada en los últimos años en España.
El pasado marzo, el alto tribunal europeo con sede en Estrasburgo, condenó al país transalpino por su lentitud e ineficacia en la protección de una familia ante la violencia ejercida reiteradamente por el padre.
La Corte Europea de Derechos Humanos lamenta en su sentencia contra Italia por el clamoroso caso de Elisaveta Talpis, una mujer que vio cómo su marido maltratador acuchillaba mortalmente al hijo de ambos de 19 años cuando este la defendía de las amenazas con el arma blanca que portaba el criminal.
Ni siquiera las sucesivas denuncias presentadas ante la justicia italiana por su esposa contra este individuo, alcohólico y agresivo, evitaron el crimen del hijo cuando intentaba defender a su madre.
Los jueces europeos que condenan a Italia por su inacción en los temas de violencia machista consideran que su sistema judicial violó tres artículos de la convención europea para los derechos humanos y sus autoridades generaron una evidente “impunidad” después de mantener en un limbo burocrático las reiteradas denuncias de la víctima.
“Las leyes existen pero nos falta formar y sensibilizar a los operadores, a las fuerzas del orden, a magistrados y servicios sociales para que no subestimen la violencia contra las mujeres y los menores”, apuntaba Donatella Ferranti, presidenta de la comisión de justicia de la Cámara de Diputados. “Se trata de una sentencia histórica para Italia. Es la primera y es sobre todo una llamada de atención”, explicó Sara Menichetti, abogada de la víctima.
El Instituto de Investigación Económica y Social italiano contabilizó en el período 2000-2015 en Italia más de 2.800 feminicidios, de los que una amplia mayoría de ellos, 1.740 concretamente, se ejecutaron en la última década.
