The spokesman of Judges for Democracy published in his Facebook profile a Decalogue to end the ‘ shame ‘ that killed more than 100,000 people who remain in mass graves.
Joaquim Bosch , spokesman for the progressive Association of Judges for Democracy , wanted to explain in a simple way and through a Decalogue their stance on the situation of the families of the victims of Francoism and the “shameful ” Spanish Government action to not favor or even allow the recovery of their remains . Spain , reminded the judge , is the second country with the highest number of ‘disappeared’, behind Cambodia.
Today it’s more important than ever to remember what happened as fascism is stirred up again to protect corrupt politicians and put down protests at mass poverty.
The “ten things you should know about the crimes of Francoism ” are, according to Joaquim Bosch on his facebook page , the following :
1. – The July 18, 1936 did not start a civil war . What happened was that a group of soldiers staged a coup against a democratically elected government .
2. – The coup was supported militarily, ideologically and economically by the Germany of Hitler. When the rebellion did not succeed all over Spain, Nazi Germany began testing its weapons against defenseless civilians , in a criminal trial of what would later happen around Europe.
3 . – Hundreds of thousands of people died as a result of the war. They are still buried in mass graves, more than 100,000 people who were killed by those who rose against the constitucional order.
4 – Most people who remain unidentified in the pits or mass graves had not gone to any war. They were exterminated in the strategy of the coup to eliminate any dissent and terrorize the whole population.
5 . – Pinochet confessed his admiration for this form of military uprising and applied it in Chile. He was one of the few heads of state who attended the funeral of Franco.
6 . – The repression did not end in 1939. The crimes , torture and serious human rights violations continued for 4 decades , until the end of the Franco regime. The renowned historian Paul Preston has noted that there is no equivalent in Europe to the intensity and duration of these atrocities of State.
7 . – Spain has the world’s second highest number of disappeared, behind Cambodia. The UN has demanded that the present state powers in Spain protect the rights of the families of the victims of the ‘Franco regime’.
8 . – The Spanish Supreme Court has ruled that the crimes of Francoism can not be criminally investigated . It has referred to the families of the victims to the Law of Historical Memory , advising that through the public administrations they may proceed with the exhumation of the remains . The current Government froze all plans to begin exhumations as soon as it took office.
9 . – It is shameful that a democratic state keeps unidentified without a decent burial those killed by a totalitarian regime.
10 . – In this situation we can all do a lot. It is perfectly possible that those who died for their democratic convictions will be finally taken out of the death-pits. We can spread a wide state of opinion in favor of the exhumations . We can demand that the Government respect the right of families to recover the remains of their loved ones. Lets not forget those who gave their lives for a more just society . Pass on this message.

Joaquim Bosch, portavoz de la asociación progresista Jueces para la Democracia, ha querido explicar de forma sencilla y a través de un decálogo su postura sobre la situación de las familias de las víctimas del franquismo y la “vergonzosa” actuación de Gobierno español al no favorecer ni siquiera la recuperación de sus restos. España, recuerda el magistrado, es el segundo país del mundo con mayor número de desaparecidos, detrás de Camboya.
Las “diez cosas que deberías saber sobre los crímenes del franquismo” son, según expone Joaquim Bosch en su página de facebook, las siguientes:
1.- El 18 de julio de 1936 no comenzó una guerra civil. Lo que ocurrió fue que un grupo de militares dio un golpe de estadocontra un gobierno elegido democráticamente.
2.- El golpe de estado fue apoyado de forma militar, ideológica y económica por la Alemania de Hitler. Cuando la rebelión no triunfó en todo el territorio, la Alemania nazi empezó a probar su armamento contra civiles indefensos, en un ensayo de lo que haría posteriormente en Europa.
3.- Cientos de miles de personas murieron como resultado de la contienda. Todavía siguen enterradas en fosas comunes más de 100.000 personas, que fueron asesinadas por quienes se levantaron contra el orden constitucional.
4.- La mayoría de las personas que siguen sin identificar en las fosas no había ido a ninguna guerra. Fueron exterminadas dentro de la estrategia del golpe militar de eliminar cualquier posible disidencia y atemorizar al conjunto de la población.
5.- Pinochet confesó su admiración por esta forma de alzamiento militar y la aplicó en Chile. Fue uno de los pocos jefes de Estado que acudió al funeral de Franco.
6.- La represión no terminó en 1939. Los crímenes, torturas y graves violaciones de derechos humanos se prolongaron durante décadas, hasta el final del franquismo. El prestigioso historiador Paul Preston ha señalado que no existe equivalente en Europa respecto a la intensidad y duración de estas atrocidades de Estado.
7.- España es el segundo lugar del mundo con más desaparecidos, por detrás de Camboya. La ONU ha exigido a nuestros poderes estatales que protejan los derechos de los familiares de las víctimas del franquismo.
8.- El Tribunal Supremo consideró que ya no podían ser investigados penalmente los crímenes del franquismo. Remitió a los familiares de las víctimas a la Ley de la Memoria Histórica, para que por parte de la administración pública se procediera a las exhumaciones de los restos mortales. El Gobierno actual paralizó al comenzar su mandato el plan de exhumaciones que se inició en su momento.
9.- Resulta vergonzoso que un Estado democrático mantenga sin identificar y sin una sepultura digna a las víctimas mortales de un régimen totalitario.
10.- Ante esta situación todos podemos hacer mucho. Es perfectamente posible que los muertos por sus convicciones democráticas salgan por fin de las fosas. Generemos un amplio estado de opinión a favor de las exhumaciones. Reclama al Gobierno que respete el derecho de los familiares a recuperar los restos de sus seres queridos. No olvidemos a quienes dieron su vida por una sociedad más justa. Pásalo.
